Charlotte Hayes, Coaching Health & Fitness is passionate about helping you to achieve your fitness goals and aims to do so in a professional, motivating and community-based way. Please ensure that you read through these Terms and Conditions fully and do not hesitate to contact us if you have any queries.

By agreeing to take part in any sessions/classes or booking any of the services provided by Charlotte Hayes, you agree to adhere to the following terms and conditions:

 

Intellectual Property

 

The content of Charlotte Hayes, Coaching Health & Fitness exercise programs, nutritional guides, marketing and website materials is the sole property of Charlotte Hayes and is subject to copyright, trademarks, database right and other intellectual property rights.

You undertake to use such materials for your own personal, non-commercial use provided that you keep intact all and any copyright and proprietary notices. You may not reproduce, modify, copy, or distribute or use for commercial purposes any of the materials without written permission from Charlotte Hayes.

Charlotte Hayes, Coaching Health & Fitness doesn’t accept any liability whatsoever for any indirect loss consequential loss, loss of data, loss of income or profit, loss of damage to property and (or) loss from claims from third parties arising out of the use of Charlotte Hayes, Coaching Health & Fitness website or services rendered by Charlotte Hayes or any other damage whatsoever caused.

 

Minimum Age

All clients must be a minimum of 18 years of age. You may be asked to provide proof of age and Charlotte Hayes reserves the right to not train individuals who are unable to confirm their age.

 

Medical & Health Concerns

By undertaking training with Charlotte Hayes, you agree that you have no undisclosed injury or illness that may affect your ability to undertake rigorous exercise or be affected by any of the services provided by Charlotte Hayes. To the best of your knowledge, you are ready and able to undertake exercise programs or receive any of the services provided by Charlotte Hayes. Charlotte Hayes, Coaching Health & Fitness cannot be held liable in any way for any undeclared medical conditions.

You also agree to obtain medical clearance from your GP / specialist health consultant prior to beginning training if there are any medical concerns.

If any exercise(s)/services causes pain or discomfort, you agree to cease the exercise/service and will advise Charlotte Hayes immediately. After assessing the issue, Charlotte Hayes will either find an alternative exercise/service for you or advise you to temporarily stop training/ stop the treatment and possibly seek medical advice before commencing training/receiving treatment again.

You must advise Charlotte Hayes immediately, in writing, if you become ill or injured and have been advised by your GP to temporarily discontinue training/ stop any treatments.

The advice and instructions provided by Charlotte Hayes is not intended to replace or be construed as medical advice.

Participating in exercise does involve the risk of injury (both minor and potentially major). Please be aware that you do take exercise up at your own risk and Charlotte Hayes will not be liable for any injury sustained by you whilst participating in any of our sessions, except where the injury was caused by Charlotte Hayes gross negligence or intentional act.

 

Payment

We reserve the right to review our classes and membership fees from time to time but will give you at least one calendar months’ notice via email of any such changes.

Payment Terms for Charlotte Hayes, Coaching Health & Fitness  Memberships, Services & Programs:

  • Payment must be made in advance via bank transfer however, sessions/ programs/treatments do not have to be booked at the time of payment.

  • All bank transfer payments are required to be paid on the 1st of each month.

  • All prices and charges include VAT at the rate applicable at the time of payment.

 

By signing up to Charlotte Hayes, Coaching Health & Fitness membership plans, you are agreeing to a minimum commitment period of 1-month membership, which will begin from the date of purchase. For each month, the payment will need to be transferred.

 

Although every effort will be made to ensure all sessions run as planned, Charlotte Hayes, Coaching Health & Fitness the right to cancel any sessions/programs due to trainer unavailability, restricted access to the training ground, adverse weather conditions or any other reason that would prevent a session from safely taking place. Members/ clients will be advised via email.

 

Refund Terms

 When you sign up to Charlotte Hayes, Coaching Health & Fitness membership or health program, any sessions that you miss will be deemed as lost time and you will not be entitled to any refund or discount. Nor will you be able to claim the time back at a later date.

 

Late Payments, Cancelling / Suspending your Membership

Whilst in your minimum commitment period, you cannot cancel your membership unless it is due to a medical condition or injury. Charlotte Hayes, Coaching Health & Fitness will require a full medical doctor’s note stating that you are unable to exercise for an extended period due to ill health. We will not be able to accept cancellation without this.

Our Right to Cancel Your Membership:

We reserve the right to cancel your membership with immediate effect if you:

 • Are in breach of these terms and conditions

• Put the health, safety or well being of other members or Charlotte Hayes, Coaching Health & Fitness at risk

• Engage in disruptive or violent behavior

• Are found to have engaged in bullying, body-shaming, or harassment of any kind towards another member.

 

Personal Belongings

Charlotte Hayes, Coaching Health & Fitness does not accept liability for the safekeeping of your personal belongings whilst you are attending any sessions or personal training sessions. You assume all risk of loss / damage for any of your personal belongings.

 

General  Information

Charlotte Hayes, Coaching Health & Fitness sessions are held in all weather conditions throughout the year (in person or online). It is your responsibility to ensure that:

• You have the correct clothing / footwear to ensure personal safety and comfort

• Provide your own water to ensure you are hydrated throughout the session

• Wear sunscreen / insect repellent where applicable (considering any allergies you may have)

Please ensure that you arrive/are available at least 5 minutes before your session is due to begin. Any time that is lost due to tardiness will not be made up at the end of the session.

Although every effort will be made to ensure all sessions run as planned, Charlotte Hayes reserves the right to cancel any sessions due to trainer unavailability, restricted access to the venue, adverse weather conditions or any other reason that would prevent a session from safely taking place. Members/ clients will be advised of the cancellation as soon as possible via email.

Charlotte Hayes offers no guarantees / warranties for the advice, instructions or information provided to any member/client. You understand that in order to achieve your goals, you must fully commit to your training program and your progress will depend solely on your own effort and dedication both in and out of session with Charlotte Hayes.

 

Miscellaneous

For all written communications, it is your responsibility to ensure it has been received by Charlotte Hayes. If you have not had an acknowledgement from Charlotte Hayes within 48 hours of sending your email / letter, please contact her on 07841209211 to ensure it has been received.

Charlotte Hayes, Coaching Health &  Fitness continually seeks to improve the service offered to members/ clients and reserve the right to make changes to any part of the services provided, but will ensure that the content or functionality is not materially reduced.

Charlotte Hayes, Coaching Health & Fitness reserve the right to amend these Terms and Conditions should the need arise. We will give you at least one calendar months’ notice to inform you of any significant changes that may affect your membership/service/program and to publish the updated Terms and Conditions on the website and via email.
